The Firm is specialized in following and managing the real estate enforcement procedures delegated to Avv. Gianluca Paracciani by Tribunale di Milano, pursuant to Art. 591bis Code of civil procedure, often combined with the custody of the real estate property subject to foreclosure.

The ever increasing number of forced expropriation procedures, recorded in the recent years, demands deep competence, transparency and neutrality in performing the delicate functions of delegate and custodian.
The forced sale is carried out and managed by the delegated professional throughout every single phase: starting from the drafting and publication of the notice of auction until the auction clearing and the preparation of the transfer decree. In conclusion, the delegated professional drafts the project, indicating the distribution to creditors of the amount collected through the auction, and transmits it to the Court.

While carrying out these activities, Avv. Paracciani and his collaborators, beside relating with all the parties of the enforcement procedure, provide to the parties interested in the purchase of the real estate property, all the information necessary to present the offer as to participate in the auction (and – in case they have been appointed also as custodian – they organize the visits to the property).

Subsequently, they will take care of all the formalities for the registration, transcription and cadastral transfer of the transfer decree and proceed to cancel all the detrimental formalities of transcribed foreclosures and inscribed mortgages.
